On 5/28/2021 the Department of Homeland Security (DHS) officially banned the Trump era policy of separating children from parents who are caught crossing the border without documentation, and put important limits on prosecution of parents for illegally entering the United States. Customs & Border Protection (CBP) Acting Commissioner Troy Miller issued a memo banning the referral of parents for prosecution exclusively on the grounds of illegal entry to the country. However, the memo includes an exception allowing CBP to refer for prosecution when  there are national security concerns, but officers must first obtain approval of higher-ranking officials and local counsel.
