February 2012 Visa Bulletin Advances One Year for EB2 Visa Filings
For those individuals born in China and India with EB2 Visa priority dates earlier than January 2010 will be eligible to file Adjustment of Status petitions if they have not already done so. This amounts to a one year advancement since last month’s visa bulletin.
The EB2 visa category is one that most often requires the candidate to have at least a Master’s level of education or a Bachelor’s degree plus 5 years of progressively responsible experience. Indian and Chinese nationals have for years been frustrated by the slow pace of the Visa bulletin for the EB2 Visa category.
Finally, the numbers have advanced considerably to where many individuals will finally be given the opportunity to file their Adjustment of Status petitions. Not only have these individuals been forced to wade through the immigrant Visa petition process itself, but after having gone through the Labor Certification and I-140 filings, they have had to wait for the Immigrant Visa to be available to them.
The EB2 Visa category has for many years been current for foreign nationals from all other countries, which essentially means that they have not had to await for visa availability. They instead only have to wait out the petition process itself. We have numerous clients who have been waiting this process out and we can finally submit their Adjustment of Status petitions on February 1, 2012.
